Tank/Vessel Warranty Policy

This Limited Warranty Policy provides a standard 3 Year Warranty for vessels delivered in the United States and made by Holloway America, covering defects in material and workmanship under normal use. It outlines claims, return procedures, exclusions, and limitations.

Limited Warranty Policy

1. Warranty Coverage

Seller warrants to the original purchaser (“Buyer”) that vessels manufactured by Seller and delivered within the United States are free from defects in material and workmanship under normal use for three (3) years (36 months) from the date of shipment (“Warranty Period”). Vessels delivered internationally are covered by a one (1) year (12 month) warranty.  For purposes of this warranty, “defects” are defined as failures in materials or workmanship occurring under normal operating conditions, and not caused by external factors or improper use as specified below. 2. Warranty Claims and Notice

To obtain warranty service, the Buyer must provide written notice of any alleged defect within the applicable Warranty Period. Acceptable forms of notice include email, registered mail, or any mutually agreed method. Upon receipt of such notice, Seller will promptly evaluate the claim. In the event of a dispute regarding whether the vessel is defective, Seller reserves the right to obtain an independent third-party evaluation.

If Seller determines the vessel is defective, Seller’s sole obligation shall be to repair, replace, or (at its option) accept the return of the vessel.  At Seller’s discretion, Holloway may travel to the jobsite or final destination to perform on-site repairs.  Alternatively, if Seller and Buyer agree that the vessel should be sent to Holloway for repair, the Buyer shall be responsible for all associated freight charges.  Once Seller has provided written agreement to accept the return, the Buyer must complete the return within thirty (30) days.

Seller shall not be responsible for any costs, expenses, or losses incurred by Buyer due to equipment downtime, including but not limited to lost production time, labor costs, lost revenue, or any other consequential damages arising between the time of equipment failure and completion of repair or replacement.


3. Warranty Exclusions

This warranty does not cover:

  • Wear and Tear: Ordinary wear and tear, erosion, or corrosion, including but not limited to rouging or surface issues resulting from materials deposited upstream in the process.
  • Post-Delivery Damage: Scratches, gouges, or other surface damage occurring after delivery.
  • Thermal Shocking: Damage due to excessive thermal shocking beyond the parameters defined in the Holloway datasheet on Thermal Shocking.
  • Improper Use: Unintended use, misuse, abuse, unauthorized modifications, or improper handling, operation, or storage by Buyer or any third party.
  • External Delays: Any inability of Seller or its subcontractors to make timely delivery due to Acts of God, labor disputes, governmental intervention, or any other cause reasonably beyond Seller’s control.


4. Third-Party Manufactured Components

Equipment, parts, or accessories manufactured by third parties are subject solely to the warranties provided by their respective manufacturers.  Any warranties or claims differing from those stated herein are unauthorized by Seller and shall be solely the warranty of the party making them, unless specifically authorized in writing by an officer of Seller.


5. Limitation of Liability

EXCEPT AS EXPRESSLY PROVIDED ABOVE, SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE ITS EQUIPMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  Any repairs, alterations, or modifications made by Buyer without Seller’s prior written authorization are not covered under this warranty.  This warranty is in addition to, and does not affect, any non-waivable statutory rights which may be available to Buyer.


6. Governing Law 

This Warranty shall be governed by and construed in accordance with the laws of the state of Missouri.
